Resumen
Given the regulation and interpretation of the Peruvian University Act that under-mines the employment status of private university professors, a reexamination is proposed from the Constitution. It is argued that the right to job stability from the outset, the principle of continuity, and the protective principle require an objective reason for fixed-term contracts. The university law is not outside the scope of the Constitution; therefore, it must respect the principle of legal reserve and the principle of equality. These principles ensure that the fundamental rights of workers are not nullified, nor are they emptied of their content.
