Abstract

The family is the origin of the community, society and the State, differentiating itself from these groups by operating in the private sphere and those in the public sphere. However, this supposed opposition does not exist. Its principles and characteristics are transmitted to the State, which will protect the type of family on which it is based. The Constitutional State is not the exception and its full development will depend on the way in which the family relations of its nation handle the concepts of Liberty and Equality and privilege some of them. Since the family is a natural institution, the State can only recognize it. The defense of a specific type will respond to not only moral reasons, but also practical ones, to guarantee its existence.
